The conveyancing process for buyers
Step 1: Contract review
Our Bendigo conveyancers review the contract of sale, identifying and addressing any risks or compliance issues. Entry Conveyancing offers free contract reviews for buyers to make an informed decision when purchasing a property.
Step 2: Onboarding
We’ll discuss the details of the property purchase, including ownership arrangements for the Manner of Holding on Title and eligibility for Stamp Duty Concessions. Conveyancers will also negotiate with the seller’s representatives to minimise financial risks for the buyer.
Step 3: Due-diligence checks
Due-diligence includes reviewing building and pest inspections to understand current condition of the property, and property searches to check for outstanding legal issues such as title defects or existing easements. Conveyancers facilitate the checks and highlight any risks.
Step 4: PEXA workplace set up
Entry Conveyancing conducts digital conveyancing on the PEXA platform. Conveyancers provide buyers and sellers with SRO duties forms to sign before setting up a shared PEXA workspace where the transaction documents are hosted. The buyer’s financier is also invited to the PEXA workplace.
Step 5: Pre-settlement
Preparation for settlement will involve a final inspection of the property to confirm that it is in an acceptable condition for purchase. Conveyancers finalise the Statement of Adjustments one week before settlement and deliver it to the seller’s representative for review.
Step 6: Settlement
Conveyancers from both parties facilitate settlement by performing the final checks, exchanging the property title, and arranging the disbursement of funds. Upon settlement completion, our Bendigo conveyancers notify the buyer and lodge the new property registration with the Victorian Land Titles Office.
The conveyancing process for sellers
Step 1: Consultation
Entry Conveyancing provides sellers with a free consultation to discuss the condition of the property and details of the sale.
Step 2: Contract preparation
Our Bendigo conveyancers assist in drafting the contract of sale and the vendor statement (section 32 document). The terms of the sale and the legal description of the property are accurately listed in line with the seller’s preferences and Victorian property law.
Step 3: Exchange of contracts
The finalised contract of sale is sent to potential buyers. Conveyancers start making preparations for settlement when a buyer signs the contract.
Step 4: PEXA workspace
The PEXA platform facilitates digital conveyancing for a secure transaction. We prepare the SRO duties forms for buyers and sellers to sign, and set up a PEXA workspace to safeguard the transaction’s documents. The buyer’s financier will also be invited to the workspace.
Step 5: Pre-settlement
The buying party provides evidence of loan approval and the Statement of Adjustments outlining the final payment details. Buyers will conduct a final inspection of the property to check that all conditions of the sale are met.
Step 6: Settlement
Our conveyancers attend settlement to conduct the final signatures, exchange the property title, and receive the purchase funds from the buyer. Upon settlement completion, we inform sellers and provide a final letter with details on the entire transaction.
