How it works for buyers

Step 1: Contract review

We review the contract of sale to check for any potential risks and liabilities. Our conveyancing lawyers will provide advice and negotiate any necessary changes before the contract is signed.

Step 2: Gathering information

We work with you to prepare the necessary information for the transaction, including property registration arrangements and stamp duty concession eligibility.

Step 3: Due diligence checklist

Our conveyancers arrange for Building & Pest Inspections, Property Title Searches and Verification of Identity to ensure all aspects of the purchase are checked.

Step 4: Completion of SRO Duties Online Form and preparing a Pexa Workspace for the Electronic Settlement

Once the SRO Duties Online Form is ready, we send it to all parties for electronic signing. A PEXA Workspace will be set up with invitations to the vendor’s representative and our client’s financier. The PEXA Workspace will house the transaction documents, including the Transfer of Land and Notice of Acquisition, and is used for electronic settlement.

Step 5: Pre-Settlement

By this stage, clients will have approval from their financier for the release of funds. Our conveyancers will prepare the Statement of Adjustments one week prior to settlement. We will assist clients with a final inspection of the property to ensure all inclusions and special conditions are met.

Step 6: Settlement and handover

The Transfer of Land documents are lodged with the Land Titles Office during settlement, and the funds are disbursed. We notify the client once settlement is complete and send the Notice of Acquisition to the Council, Water & Owners Corporation (if applicable). We also send clients the final letter with the handover of keys.

How it works for sellers

Step 1: Consultation

We’ll meet to discuss the outcome and details of the sale, including the preparation of the contract of sale and section 32 document.

Step 2: Document preparation

Our conveyancers prepare the contract of sale and vendor statement in line with the conditions of the property and sale outcome.

Step 3: Signed contract

Once a buyer has signed off on the purchase, we will arrange to ensure that the conditions of the sale are met, including maintenance or repair work, deposit payments, and building inspection preparations.

Step 4: Setting up a PEXA Workspace

We send SRO Duties Online forms to all parties for signing and submit them to open a PEXA Workspace. The buyer’s representative and financier will be invited to the digital workspace in preparation for settlement. Our conveyancers will prepare the Transfer of Land document on behalf of clients.

Step 5: Settlement preparation

We receive and review the Statement of Adjustment from the buying party a week before settlement on behalf of clients. After final payment confirmation, we schedule a property inspection for the buyer to assess its condition.

Step 6: Settlement

Settlement will involve the lodgement of Transfer of Land documents with the Land Titles Office, and the disbursement of funds. We notify the client once settlement is complete and send the Notice of Acquisition to the Council, Water & Owners Corporation (if applicable). We also send clients a formal settlement letter containing the confirmation of the transaction.
