How it works for buyers

Step 1: Contract review

Our conveyancers review the contract of sale to identify any liabilities or risks involved. We negotiate changes to the contract of sale (such as the addition of special conditions) before signing to ensure minimal financial risk for buyers.

Step 2: Gathering information

A title search is requested through Victoria Land Registry Services to check the property’s history, easements, and any planning restrictions. We confirm the ownership registration details with buyers (sole or joint ownership).

Step 3: Due diligence checks

We arrange building and pest inspections to uncover any hidden issues with the property. If any issues are found, we notify the buyer and renegotiate better terms with the seller. When buyers are ready to proceed with the transaction, we assist with contract signing and the transfer of the deposit.

Step 4: Set up the PEXA workspace

Conveyancing will be facilitated digitally on the PEXA platform to ensure a secure transaction. In preparation for the setup of the PEXA workspace, we send SRO duties forms to all parties for signing and host the transaction documents on the shared platform. The vendor’s representative and the buyer’s financier will be invited to the workplace.

Step 5: Pre-settlement

At this stage, the buyer’s financier will have approved the funds for the property purchase. One week from settlement, we prepare the Statement of Adjustments and send it to the vendor’s representative for review. We then arrange a final inspection of the property to make sure all special conditions and inclusions have been met.

Step 6: Settlement

At settlement, our conveyancers perform final checks for the Transfer of Land documents and liaise with the buyer’s financier for the disbursement of funds. The keys and property title are received from the vendor’s representative, and the settlement is finalised. After settlement, the new property registration is lodged with the Land Titles Office.

How it works for sellers

Step 1: Initial consultation

We meet with sellers to discuss the property’s condition and the desired outcomes of the sale.

Step 2: Document preparation

We draft the contract of sale and the section 32 report, ensuring that our client’s interests are fully represented.

Step 3: Contract exchange

The contract of sale and vendor statement are finalised and sent to the buyer’s agent for review. Changes to the contract of sale may be negotiated with the buyer’s agent for an arrangement.

Step 4: Set up PEXA workspace

Conveyancing is facilitated on the PEXA platform to ensure a secure transaction. We send the SRO digital duties form to all parties to sign and verify before inviting the buyer’s agent and financier to the workspace.

Step 5: Pre-settlement

The Transfer of Land documents are finalised in preparation for settlement. One week before settlement, we receive and review the Statement of Adjustments from the buyer’s agent to confirm the final payment amount.

Step 6: Settlement

During settlement, we conduct the final checks, confirm the transfer of the purchase amount, and lodge the Transfer of Land documents with the Land Titles Office. We notify the seller once settlement is complete and send the Notice of Acquisition to the Council, Water & Owners Corporation (if applicable).
