How it works for buyers

Step 1: Contract review

Our conveyancers review the contract of sale to identify any compliance issues or liabilities for the buyer. We negotiate any changes to the contract to ensure it’s in our client’s favour before signing.

Step 2: Gathering information

We confirm the details for the property’s registration (personal ownership, joint tenants, company ownership, etc.) and check for applicable stamp duty concessions.

Step 3: Due diligence checklist

We arrange for independent Building & Pest Inspections, Property Title Searches, and Verification of Identity as part of the due diligence checks for the property transaction.

Step 4: Preparation of SRO Duties Online Form and opening a Pexa Workspace for the Electronic Settlement

Conveyancing will be carried out on the PEXA platform. We prepare the SRO Duties Online Form for all parties to sign and set up a PEXA Workspace where the transaction documents, including the Transfer of Land and Notice of Acquisition, will be held. The vendor’s representative and our client’s financier are then invited to the Workspace.

Step 5: Pre-Settlement

Funds for the property purchase will be approved by this stage. Our conveyancers will prepare the Statement of Adjustments one week before settlement. Next is the final inspection of the property to check all special conditions and inclusions have been met.

Step 6: Settlement and handover

On settlement day, we liaise with the vendor’s representative and our client’s financier for the transfer of funds and the handover of the Transfer of Land documents and keys to the property. After settlement, we will notify the client and lodge the property registration with the Land Titles Office. If required, we will also send the Notice of Acquisition to the Council, Water & Owners Corporation for occupation.

How it works for sellers

Step 1: Initial consultation

The initial consultation with vendors will cover the property’s condition and the goals of the sale.

Step 2: Preparing documents

With the information from the initial consultation, we prepare the contract of sale and section 32 document.

Step 3: Post-contract signing arrangements

Once a buyer has signed the contract of sale, we make arrangements to address any special conditions outlined in the contract, such as maintenance or repair work and building inspection preparations.

Step 5: Preparation for settlement

We review the Statement of Adjustment from the buying party a week before settlement. After confirming the final payment amount, we schedule a property inspection for the buyer to assess its condition.

Step 6: Settlement and handover

Settlement will involve the lodgement of Transfer of Land documents with the Land Titles Office, and the disbursement of funds. We notify the client once settlement is complete and send the Notice of Acquisition to the Council, Water & Owners Corporation (if applicable).
